Background:

The proposed Replat is for Lot 9 within Phase 1 of the Oakleigh subdivision. The property carries the Residential Single Family Estate (RE-1) zoning designation. The current setback requirement for residential lots over one acre is 15-foot rear, 10-foot side, and 15-foot front. There is also a platted 15-foot-wide buffer on the rear of the lot. The applicant is requesting a reduction down to 15-feet coincident with the platted buffer and current setback allowances. This will allow for additional building area in the rear of the lot. The applicant is not requesting a reduction to any other setbacks, and they are greater than the current allowance. Pursuant to ULDC 401.17(b) The Development Review Committee shall review and make recommendations on plats and replats to the BoCC.

The Board of County Commissioners must determine that the Replat is consistent with the Comprehensive Plan and Unified Land Development Code. The Board of County Commissioners has the authority to approve the reviewed Replat per Section 401.02(e)10
