Background:

The proposed replat is for Lot 34 within the Santa Fe Pass subdivision. The property is within a Planned Development. The current front setback requirement within the PD is 50 feet. A new home is currently under construction, and the builder made an error when measuring from the front property line. The form boards and slab for a portion of the home were located 40 feet instead of 50 feet as required on the original plan. The owner is requesting a replat to correct the encroachment. The applicant is not requesting a reduction to any other setbacks. ULDC 402.89 (c) Revision of planned development district allows the DRC to approve changes in setbacks on single lots as a Minor Change. Pursuant to ULDC 401.17(b) The Development Review Committee shall review and make recommendations on plats and replats to the BoCC.

The Board of County Commissioners must determine that the Replat is consistent with the Comprehensive Plan and Unified Land Development Code. The Board of County Commissioners has the authority to approve the reviewed Replat per Section 401.02(e)10.
