Background:
The applicant is requesting to rezone from the (A) Agriculture zoning district to the (BP) Business/Professional zoning district on a 1 acre parcel that contains a preschool. The parcel’s current zoning of (A) Agriculture is inconsistent with the future land use designation of Commercial. The current zoning makes the preschool nonconforming with the zoning and nonconforming uses are not allowed to be expanded, per Sec. 408.12 of the Unified Land Development Code (ULDC). As the applicant desires to increase the building footprint area on the parcel, a rezoning to a zoning district that allows childcare centers and that implements the Commercial land use category is necessary.
