Background:
The proposed replat is for Lot 88 in the Emerald Woods II Subdivision. The property carries the Residential Single Family (R-1A) zoning designation. The current setback requirements for Residential Single Family zoning districts is outlined in Table 403.07.02 of the ULDC which allows the following minimum building setbacks for lots less than one acre: 10-feet front or street; 10-feet rear; 5-feet interior side; 7.5-feet rear accessory building.

This application proposes setback changes to all of the setbacks to meet the current code for residential zoning districts per ULDC Table 403.07.02 as applicable. The proposed setback changes in this replat will provide the space necessary to correct the existing encroachment of the home in the side (north) setback and construct an accessory building in the rear (east) setback.

Pursuant to ULDC 401.17(b) The Development Review Committee shall review and make recommendations on plats and replats to the BoCC.

The Board of County Commissioners must determine that the Replat is consistent with the Comprehensive Plan and Unified Land Development Code. The Board of County Commissioners has the authority to approve the reviewed Replat per Section 401.02(e)10
