Background:

The original plat, approved in 2006 (Plat Book 27 Page 14), identifies Lot 38 as having a 25-foot front setback, 10-foot side setback, and 20-foot rear setback. It did not provide for an accessory use setback. The replat provides for “setbacks consistent with the zoning district setbacks in Chapter 403, ULDC. Contact Alachua County Growth Management Department for any and all setback requirements”. The current code for residential zoning districts per ULDC Table 403.07.02 allows the following setbacks for lots less than one acre: 10-feet front or street; 20-feet garage front; 10-feet rear; 5-feet side; and accessory building setback of 7.5-feet for the rear. The proposed setback changes in this replat will provide additional room at the back of the lot for accessory structures or a pool.

Pursuant to ULDC 401.17(b) The Development Review Committee shall review and make recommendations on plats and replats to the BoCC.

The Board of County Commissioners must determine that the Replat is consistent with the Comprehensive Plan and Unified Land Development Code. The Board of County Commissioners has the authority to approve the reviewed Replat per Section 401.02(e)10.
