Background:

This application proposes a replat to combine lots 1 and 2. These lots are currently part of the same parcel but are separate platted lots. The owner wants to construct a residential unit over the lot lines between these lots. The existing plat has a note that there is a 10-foot-wide easement for public utilities along all front and side lot lines.

No utilities exist within these easements. Unified Land Development Code Section 402.56 (c) Platting required stipulates that a replat is required to combine two or more platted lots if there are easements on the plat (unless the easements can be avoided).

Pursuant to ULDC 401.17(b) The Development Review Committee shall review and make recommendations on plats and replats to the BoCC.

The Board of County Commissioners must determine that the Replat is consistent with the Comprehensive Plan and Unified Land Development Code. The Board of County Commissioners has the authority to approve the reviewed Replat per Section 401.02(e)10.
