Background:

Impacts to wetland buffers need BoCC approval via a Preliminary Development Plan (COSE Element 4.7.7; ULDC 406.46). The property includes wetlands and wetland buffer adjacent to Lake Santa Fe, a designated Outstanding Florida Water (OFW). Strict application of the County’s current wetland standards would make the lot unbuildable. Because the lot was legally created, the County must allow reasonable use of the land. Reasonable use of the land is considered to be a single-family dwelling with associated infrastructure, provided that all practicable efforts are made to avoid and minimize adverse impacts to wetlands and wetland buffers (i.e., compliance with current Comprehensive Plan and ULDC to the extent practicable). The wetland buffer cannot be fully avoided, and the applicant has made modifications to the proposed dwelling to minimize impacts. Staff supports the Fee-in-Lieu option for mitigation [406.114(d), 150% of appraised value of impacted area] with funds placed in the Environmentally Sensitive Lands Fund.
