Background:

Arrivalist Co. provides visitation reporting on the unique volume of visitor trips, length of stay, day of visit, and location, and enables destinations to geo-fence attractions, hotels, venues, and points of interest. This consumer research will enable the Visitors and Convention Bureau to strategically align marketing investments to effectively target both existing and new tourists to Alachua County. The County has a need for these services.

The Agreement contains a mutual indemnification provision which is not in strict compliance with Resolution 14-33. The Resolution specifies that the County shall not indemnify contracted parties without specific approval by the Alachua County Board of County Commissioners (“Board”). Efforts were made to remove or alter the indemnification requirements. As the services to be provided will be done through use of computer systems, there was determined to be a low probability of an incident occurring that will expose the County to liability. It is being requested that the Board find that accepting the mutual indemnification in the Agreement is of low risk and that the Board waive its policy and approve the Agreement.
