Background:

The proposed replat is for Lot 95 within Phase II of the Eloise Gardens subdivision. The property carries the Residential Single Family (R1-A) zoning designation. The current setback requirement for Residential Single Family zoning districts is outlined in Table 403.07.02 of the Unified Land Development Code which allows the following minimum building setbacks for lots less than one acre: 10-feet front or street; 20-feet garage front; 10-feet rear; 5-feet interior side; 7.5-feet rear accessory building.

This application proposes setback changes to all setbacks to meet the current code for residential zoning districts per ULDC Table 403.07.02 as applicable.  The proposed setback changes in this replat will provide the space necessary to correct the existing encroachment of the home in the rear (north) setback that is 12.2 feet from the rear property line. There is a platted 5-foot-wide Public Utility Easement on the front (south) of the lot that will be maintained.

Pursuant to ULDC 401.17(b) The Development Review Committee shall review and make recommendations on plats and replats to the BoCC.

The Board of County Commissioners must determine that the Replat is consistent with the Comprehensive Plan and Unified Land Development Code. The Board of County Commissioners has the authority to approve the reviewed Replat per Section 401.02(e)10.
