Background:

The Vanguard Apartments, LLC filed an application for final development plan approval of Laureate Village TND Phase 2, Units 1 and 2 on October 4, 2021.

On June 2, 2022, the Alachua County Development Review Committee issued Development Review Order DR-22-30, which approved the application with conditions.

Condition 1.a. of the Development Review Order requires the property owner to convey a drainage easement to the County for public roadway stormwater discharge rights into stormwater management facilities.

This grant of easement is for the purpose of receiving, storing, and discharging storm water runoff from public Rights-of-Way and other areas as needed necessary or appropriate by the Grantee and authorizes, but does not require, the Grantee to install, construct and operate temporary and permanent drainage improvements, including but not limited to pipes, culverts and pumps within the Property. The Grantor, its successors or assigns, may use the Property in any way which is compatible with the rights granted to the Grantee by this easement. The Grantee will not be responsible for any damages to the Grantor’s use resulting from the exercise of the Grantee’s rights under this easement.

The property owners agreed to donate the easement to Alachua County.
