Description:

Authorization to schedule and advertise notice of intent to consider amending Chapter 75 of the Alachua County Code relating to Solid Waste.  The proposed amendments to the Alachua County Code are to add language to allow the county to remove non-compliant garbage, bulk waste, yard waste from properties following notice, enhance litter prevention efforts, restrict the placement of receptacles and bulk items, require messaging on recycling containers, establish ability to deny or revoke commercial exclusions, updating code enforcement items, and update definitions among other things.

Authorize staff to schedule and advertise notice of intent to consider amending the County Solid Waste ordinance, Chapter 75 of the Alachua County Code, at the Board’s meeting to be held on March 14, 2023 at 11:30 am, or as soon thereafter as may be heard, (or on subsequent date to be selected by the County Manager), and authorize staff to publish notice of said hearing in the Gainesville Sun.

It has since been amended and updated many times including on August 16, 1984, Jan 14, 1986, Sept. 12, 1989, Apr. 23, 1991, and June 6, 1993, Apr. 23, 1996, Aug. 13, 1996, May 13, 1997, July 28, 1998, Dec. 12, 2000, July 24, 2001, Dec. 10, 2002, Aug 24, 2004, Dec. 12, 2006, Aug. 23, 2011, Feb. 25, 2020, and Oct. 13, 2020.

Background:

Since its original adoption in 1984, Chapter 75 of the Alachua County code has continually been updated and amended to meet the needs of the community through ordinance changes ranging from instituting commercial recycling requirements, to requiring franchises by commercial haulers, and establishing solid waste assessments. The current version of Chapter 75 once again needs to be updated to reflect changes to the County’s departmental name changes, changes in enforcement mechanisms, address the commission’s desire to reduce litter, and prepare the County for the upcoming exclusive franchise for commercial and residential waste among other things. A draft version of the proposed changes are attached. The final version will presented to the Board at the adoption meeting and will be made available to the public at least 10 days prior to the adoption meeting.

Pursuant to s 125.66(2), Florida Statutes, the notice must be published in a newspaper of general circulation in Alachua County at least 10 days before the date of the adoption meeting. If authorized by the Board of County Commissioners (BoCC), the attached notice will be published in the Gainesville Sun at least 10 days prior to the BoCC’s adoption meeting.
