Description:
Change use and impose restrictions on a portion of CR 2082 to prohibit motorized vehicular traffic between SE Hawthorne Road and CR 234. 500 feet of CR 2082 shall remain open from the intersection of SE Hawthorne Road and CR 2082 and the intersection of CR 234 and CR 2082 to allow access to private property and parking for the Gainesville-Hawthorne Trail. The right- of- way will be fenced off at the point of closure on each end of the corridor with appropriate signage. A gate will be installed at both locations and any adjacent property owner that enters into a license agreement will be permitted to place a lock on the gate. A cul-de-sac or hammer-head will also be constructed to provide an area for vehicles to turn around. The restricted section of the roadway will not be abandoned, vacated or demolished.

That the Board adopt the Resolution making certain findings, changing the use, and imposing restrictions on CR 2082 from 500 feet southeast of the intersection of SE Hawthorne Road to 500 feet northwest of the intersection with CR 234.

Prior Board Motions:
On March 12, 2019, the Board considered County Road 2082 Pavement Rehab Options from S.E. Hawthorne Road to S.E. County Road 234. The Board directed staff to proceed as follows:
1. Change the use and impose restrictions the roadway and return to the Board with a budget amendment to reallocate remaining budgeted funds to other CIP projects.
2. Enter into a license agreement with the State of Florida, Zetrouer Trust and the Alachua Conservation Trust to provide them with enhanced access their property.
3. If possible, move County Road 234 up the list for maintenance and maintain the southeastern access point for the trailhead and for the adjacent property owners’ driveways.

Background:
On Tuesday March 12, 2019 the Board heard a presentation for C.R. 2082 Pavement Rehab Options. The four options that were provided for consideration included the following:
1. Current Direction: Chip seal roadway
2. Maintain as graded roadway
3. Change the use of the Roadway and prohibit all motorized traffic
4. Close roadway to all traffic and direct staff to investigate the possibility of roadway vacation.
The Board chose option 3, prohibit motorized traffic.
The portion of the right-of-way on which motorized traffic will be prohibited is from 500 feet southeast of the intersection with S.E. Hawthorne Road to 500 feet northwest of the intersection with S.E. County Road 234. This will address point 2 of the Board’s prior motion and allow the County to maintain public access at each end of the right-of-way. Abutting property owners will retain access to their driveways and this area will provide access to the Gainesville-Hawthorne Trail parking area. License agreements may be brought back to the Board at a later date after coordination with the property owners is completed.
