Background:

In March of 1986 the Alachua County Board of County Commissioners (“Board”) adopted an ordinance related to Purchasing known as the “Alachua County Purchasing Code”. This code had been amended numerous times in the past and needed a major update to ensure that best practices were being used in the procurement of commodities and services.

On January 28, 2020, the Board adopted Ordinance 2020-1 amending Chapter 22 of the Alachua County Code, known as the “Alachua County Purchasing Code and replaced it with a new procurement code known as the “Alachua County Procurement Code”.

In the Procurement Code a procedure is provided on how to make a bid solicitation and award protest and how to make an appeal. On August 23, 2022, the Board heard a bid protest that followed this procedure. After hearing the bid protest, the Board directed the County Attorney to review the appeal process and provide recommendations and look at the alternative to have a magistrate review the appeals.

October 25, 2022, the Board discussed the recommendations presented by the County Attorney and authorized the Public Hearing to consider the adoption of the Ordinance to amend the Procurement Code.
