1. Approve the Addendum Agreement #13666 with Kompan, Inc. and authorize the Chair to sign the Agreement.
2. Authorize issuance of a Purchase Order 2023-1210 to Kompan, Inc for an inclusive playground at Veterans Memorial Park and authorize County Manager to sign all future project-related documents.

Funds previously allocated for the splash pad project, which became cost prohibitive, will be reallocated for the inclusive playground and other infrastructure at Veterans Memorial Park.
Project 6194109 Veterans Memorial Park: Improvements: Recreation (Conversion of Playground to Play Area) and New Construction: Other Infrastructure.
Inclusive Playground: $876,000 total project cost. The purchase order to Kompan 2023-1210 is for $875,109; additional funds added as a contingency for unexpected costs.
$350,000 Parks impact fees: Fund 339.41.4100.572.63.98
$401,000 Wild Spaces Public Places: Fund 021.41.4100.572.63.98
$100,000 Rotary Club Donation: Fund 167.41.4100.572.63.98
$25,000 Duke Energy Donation: Fund 167.41.4147.572.63.98
Other Related Infrastructure: Not to exceed $1.124 million total. Funding not completely determined, but includes: Park impact fees, Wild Spaces Public Places, Parks Capital Budget fund (Fund 318) and new surtax funding (Fund 140). Some tasks for this portion may be part of the approved Kompan agreement; others will have a separate contract.
Approving this agreement acts as an approval for the inclusive playground and the other related infrastructure to support it.

Background:
This Agreement between the County and Kompan, Inc. is piggybacking off an agreement through Omnia Partners, a cooperative purchasing program, and is coterminous with the master agreement between Kompan with the City of Charlotte, NC, with the exception of the modifications contained in the Addendum Agreement. By way of the Addendum Agreement, Kompan will provide playground equipment, outdoor fitness equipment, site accessories, surfacing and related products and services to the County on an as-needed basis. The not to exceed amount is $2 million annually. First use under this Agreement will be for an inclusive playground at Veterans Memorial Park.
This purchase is exempt from the County's competitive bidding requirements pursuant to Section 22.3-302 (13) of the Alachua County Procurement Code, Procurement of Supplies or Services under Contract with cooperatives, including cooperatives that the County participates in accordance with Article 10, Section 22.10-201 (Cooperative Purchasing Authorized), providing the vendor extends the same terms and conditions of the Contract to the County. However, since the dollar amount of the purchase exceeds the purchasing authority of the Procurement Manager, this Purchase Order is being submitted for Board consideration and approval.
