Background:
Alachua County Code, Chapter 74 concerns nuisance conditions and provides the ability for the code enforcement process, and other enforcement measures to be used to remedy, seek compliance, and abate nuisances. This ordinance adopts a new article in Chapter 74 on nuisance overgrowth, with definitions and some exceptions for applicability.
On November 1, 2020, the Code Enforcement Board ceased to exist in Alachua County and the Code Enforcement Special Magistrate was given authority and powers by the Board of County Commissioners (“Board”) to hear and consider code enforcement matters. This ordinance amends Chapter 24 of the Alachua County Code, regarding code enforcement to remove reference to the Code Enforcement Board and provide updates to the code enforcement mechanisms and processed currently used.
The County previously adopting the International Property and Maintenance Code, 2021 edition, (IPMC) in part. After review, it was determined that additional provisions of the IMPC would need exclusion and that a time period would be best to be set for requirement on the section on insect screens. Since the IPMC adoption/section is included in the Unified Land Development Code, it is requested that the Board convene as the Land Development Regulation Commission and fine the proposed amendments to the consistent with the Alachua County Comprehensive Plan.
