Background:

Policy 3.11.1 of the Future Land Use Element (FLU) of the Comprehensive Plan provides guidance on parcels with Rural Commercial-Agriculture Land Use designations. These are primarily parcels outside of both the Urban Cluster and any established Rural Cluster which have a Commercial land use designation and Commercial zoning. 

Policy 3.11.1(e) of the FLU states, “The land development regulations for this land use category shall specify performance standards required to mitigate any adverse impact of such development on adjacent land uses and affected public facilities.”  Since this policy was adopted the land development regulations have been updated to address many of these issues that ensure compatibility of uses throughout the unincorporated area and staff is of the opinion there is no additional regulation needed in some of the subject areas detailed in 3.11.1.  There are however some ways in which Commercial development outside of established Rural Clusters can mitigate their impacts as required by the policy.  Specifically, Use, Access, Design and Parking are addressed in the proposed ULDC Amendment.
