Background:

The national asset forfeiture program targets criminals including drug dealers who prey on the vulnerable for financial gain.  One of the most important provisions of asset forfeiture is the authorization to share proceeds with state and local law enforcement agencies thus providing valuable additional resources to the agencies.  These resources cannot be used to supplant the regular operating budget of the law enforcement agency and must only be used for law enforcement purposes in accordance with the Department of Justice and Department of the Treasury Guide to Equitable Sharing.  Funds received under this federal program are subject to the Single Audit Act.  A prerequisite for a law enforcement agency to receive equitably shared cash, property or other proceeds from the program is that they must annually submit an Equitable Sharing Agreement and Certification to the U.S. Department of Justice. The Sheriff’s Office has participated in the program since 1996.
