January 28, 2020, Board adopted Ordinance No. 2020-01 repealing Chapter 22 of the Alachua County Code of Ordinances, known as the "Alachua County Purchasing Code" and replacing it with a new procurement code known as the "Alachua County Procurement Code".

August 23, 2022, Board heard a bid protest that followed the appeal process of the Alachua County Procurement Code.

Background:
On January 28, 2020, the Board of County Commissioners of Alachua County ("Board") adopted Ordinance 2020-1 amending Chapter 22 of the Alachua County Code, which is known as the "Alachua County Procurement Code". In the Procurement Code, a procedure is given on how to make a solicitation and an award protest and appeal. On August 23, 2022, the Board heard a bid protest that followed this procedure. After hearing the protest, the Board directed the County Attorney to review the appeal process and provide recommendations and look at the alternative to have a magistrate review the appeals.

Alachua County Procurement and the County Attorney's Office reviewed protest procedures options. Presented for consideration are different processes used by other jurisdictions for procurement related protests and appeals.
