Background:
The current code language requiring the County to not accept applications for properties for which there are overdue taxes, liens and fines does not take into account larger master planned properties such as Transit Oriented Developments or large Planned Developments that are built over many years. As these properties develop, portions get sold and developed. Sometimes an amendment is required to the overall development plan or planned development to allow something to occur differently on undeveloped portions. County staff has recently run into the scenario that would prohibit a change if one property owner has not paid their taxes, such as a single home-owner with a home already built in a multi-phase planned development. The proposed changes would allow the application to be accepted and processed as long as the property owner of the property that would be affected by the application does not owe taxes, liens or fines to the County.
