Background:

The JAG Countywide program is administered through FDLE in accordance with Chapter 11D-9, FAC. Each County is allocated funds by FDLE. FDLE requires that the units of local government within the County reach a consensus regarding the expenditure of JAG funds. This is done in Alachua County through the Byrne Grant

Advisory Board, which makes a recommendation to the Board of County Commissioners. The Byrne Grant Advisory Board meeting was held on September 26, 2018 and their recommendation is included in the "Fifty-one Percent" letter.  On May 14, 2019, the Alachua County Board authorized the Chair to apply for local funding consistent with the “Fifty-one Percent” letter.  The Alachua County Board of County Commissioners was awarded funds for two programs to be administered by the Sherriff ($8,079.00 for Rape Aggression Defense (RAD) Training & Safe Santa Fe Initiatives; and $29,516.00 for Law Enforcement Equipment Program).

All Byrne grant recipients and sub-recipients must confirm that they are compliant with 8 U.S.C. § 1373 & 1644. These section of the U.S. Code deals with local governments' cooperation with immigration authorities and the lack of any policy prohibiting such cooperation.

The Sheriff’s counsel has determined that the programs or activities being funded by the grant is in compliance with these statutory sections.  With authorization from the Board, the County Attorney will sign and return the Certification.
