January 23 2018-Board adopted Ordinance 2018-01, which amended Section 367 of the Alachua County Code of Ordinances (Utility Installation Regulations) and created Article II, Wireless Infrastructure.

Background:

In 2019, Florida passed SB 1000, which amended Sections 202.20 and 337.401 of the Florida Statutes, to address local government regulation of access to the public rights-of-way for wireless facilities and wireless support structures and to specify limitations and prohibitions on municipalities and counties relating to registrations and renewals of communications service providers. The Act prevents local governments from prohibiting, regulating, or charging for the colocation of small wireless facilities in the rights-of-way, unless otherwise provided for in the Act.

 

Alachua County wishes to remain in compliance with SB 1000 by adopting regulations and fees for small wireless facility colocation, to the full extent allowed by the Act.
