Background:

As part of its first Final Development Plan approval, the developer of Celebration Pointe Transit Oriented Development granted a Conservation Easement to Alachua County over the Conservation Management Area associated with the development. As part of that agreement, a limited exception was permitted for a drainage structure across the existing power line easement area that was included in the Conservation Easement. The stormwater management facilities that are connected to this underground pipe accommodate runoff from the overpass constructed by Celebration Pointe over I-75. Because of this, the Florida Department of Transportation (FDOT) requires a drainage easement for the basins, and for the pipe that connects them. This Subordination Agreement satisfies the needs of FDOT, but does not affect the remaining portion of the Conservation Easement. The scope of the Subordination Agreement is only that portion where the pipe is constructed.
