Description:

Request that the Board accept the warranty deed for the Drainage Right-of-Way created by the plat of Heatherwood Unit II, recorded in Plat Book L, Page 85, Public Records of Alachua County, Florida.

That the Board adopt the resolution authorizing the acceptance of the warranty deed and execute the warranty deed.

There are recording costs for the deed, not to exceed $50.

County is currently maintaining the drainage right of way from Stormwater Assessment Fund # 146.79.7920.

Background:

In 1983 the developer of the Heatherwood neighborhood recorded the plat of Heatherwood Unit II in Plat Book L, Page 85, of the Public Records of Alachua County, Florida (copy attached).  The plat dedicated approximately 2.34 acres, as drainage right-of-way, to the public forever.  Based upon this dedication, Alachua County currently maintains the drainage right-of-way.

 

The current fee simple owner of the drainage right-of-way is a dissolved corporation and is in the process of winding up the affairs of the corporation.  The owner has approached the Alachua County Public Works Department about donating fee simple ownership of the drainage right-of-way to the County.  Public works staff has reviewed the offer and determined that it would be in the best interest of the County to own the drainage right-of-way in fee simple.

 

The property owner has provided the County with a signed warranty deed and resolution of the corporation winding up the affairs of the corporation (copies attached).
