Background:

This matter was the basis of the Shade meeting that was held on August 26th. If this matter is approved, the transcript of that meeting will become public record. In order to finalize this matter the Board must approve the settlement in a public meeting as no formal action may be taken during a Shade meeting.

 

This case involved a fall on a sidewalk off of NW 43rd St. in the vicinity of Cox Cable. She sustained significant injuries and incurred medical bills in excess of $138,000. The proposed settlement agreement is a compromise since liability is contested in this matter. The County’s position has been that this condition was not hazardous and was open and obvious and Ms. Puckett’s position is that it had been known from prior complaints and was of a nature that the County would normally have remediated.
