Description:

Alachua County Code of Ordinances, Chapter 75.601 requires a franchise agreement be approved by the County in order to engage in the business of providing commercial collection services. Due to the expected revenues from the Commercial Services Franchise Agreements between Alachua County and Waste Pro of Florida, Inc. and Alachua County and WCA of Florida, LLC. being greater than $50,000 each, the Applications and Agreements are required to be approved by the Board of County Commissioners.

Approve the Commercial Services Franchise Agreements and the Commercial Services Solid Waste Franchise Disposal Agreements between Alachua County and Waste Pro of Florida, Inc. and Alachua County and WCA of Florida, LLC.

Prior Board Motions:

On September 22, 2020, the Board of County Commissioners approved the Commercial Services Franchise Agreements and the Commercial Services Solid Waste Franchise Disposal Agreements between Alachua County and Waste Pro of Florida, Inc. and Alachua County and WCA of Florida, LLC with both terms ending on September 30, 2021.

Approving this Commercial Services Franchise Agreement and Application with Waste Pro of Florida, Inc. will allow the County to receive approximately $94,000 in revenue from Commercial Franchise Fees to account 400.76.7640.323.70.02. Approving this Commercial Services Franchise Agreement and Application with WCA of Florida, LLC will allow the County to receive approximately $263,000 in revenue from Commercial Franchise Fees. Revenue account is 400.76.7640.323.70.02.

Background:

The Alachua County Code of Ordinances, Chapter 75.601 states "It shall be unlawful to commence or engage in the business of providing commercial collection service or providing containers for commercial service to properties in the unincorporated area of the County without obtaining a franchise issued by the County." Therefore, to maintain their compliance with the Alachua County Code of Ordinances, Waste Pro of Florida, Inc. and WCA of Florida LLC are required to submit an annual Commercial Services Franchise Application, for as long as they wish to continue being allowed to provide commercial solid waste services within Alachua County. Along with the Application, they must also sign a Commercial Services Franchise Agreement with the County and receive approval by the Alachua County Board of County Commissioners. Since the Commercial Services Franchise Agreements with Waste Pro of Florida, Inc and with WCA of Florida LLC., is expected to bring in over $50,000 in revenue each, this Agreement is required to be approved by the Board of County Commissioners.
