Description:

Alachua County Code of Ordinances, Chapter 75.601 requires that a franchise agreement be approved by the County in order to engage in the business of providing commercial solid waste collection services. Due to the expected revenues from the Commercial Services Franchise Agreement between Alachua County and GFL Solid Waste Southeast LLC being greater than $50,000, the Application and Agreement are required to be approved by the Board of County Commissioners. Additionally, GFL Solid Waste Southeast LLC is entering into a separate Disposal Agreement to ensure that all the acceptable waste collected by the Franchisee will be delivered to the Leveda Brown Environmental Park and Transfer Station.

On November 9, 2021, the Board of County Commissioners approved the Commercial Services Franchise Agreement and the Commercial Services Solid Waste Franchise Disposal Agreement between Alachua County and GFL Solid Waste Southeast LLC, with terms ending on September 30, 2021.

Approving this Commercial Services Franchise Agreement and Application with GFL Solid Waste Southeast LLC, will allow the County to receive approximately $329,000 in revenue from Commercial Franchise Fees. Revenue account is 400.76.7640.323.70.02.

Background:

The Alachua County Code of Ordinances, Chapter 75.601 states "It shall be unlawful to commence or engage in the business of providing commercial collection service or providing containers for commercial service to properties in the unincorporated area of the County without obtaining a franchise issued by the County." Therefore, to be in compliance with the Alachua County Code of Ordinances, GFL Solid Waste Southeast LLC is required to submit an application and enter into a Commercial Services Franchise Agreement with the County.  Since the Commercial Services Franchise Agreement with GFL Solid Waste Southeast LLC is expected to bring in over $50,000 in revenue, this Agreement is required to be approved by the Board of County Commissioners. Additionally GFL Solid Waste Southeast LLC is entering into a separate Commercial Services Solid Waste Franchise Disposal Agreement with the County to ensure that all the acceptable waste is delivered to the Leveda Brown Environmental Park and Transfer Station.

 

As stated in the Commercial Services Franchise Agreement, by written notice dated September 28, 2020, the County provided GFL Solid Waste Southeast LLC with 3 years notice of its decision to displace all solid waste collection haulers pursuant to section 40370605(3)(c), Florida Statutes. Therefore, effective October 1, 2023, GFL Solid Waste Southeast LLC will no longer be permitted to provide garbage, trash or refuse commercial collection services within Alachua County, and any solid waste Commercial Collection Franchise Agreement that the GFL Solid Waste Southeast LLC may have with the County will terminate.
