Prior Board Motions:

Mar. 10, 2020 - Approve and adopt: (i) two sets of rules, one for agricultural/equestrian events and the other for non-agricultural/equestrian events, and authorize the County Manager, or designee, to update/amend rules on an as needed basis; (ii) the Pre-Approved Animal Acts list and authorize said acts at the Agriculture & Equestrian Center without additional Board approval; (iii) prohibition of circuses and non-human primate acts at the Agriculture & Equestrian Center; (iv) revisions to the fee schedule; and (v) the Facility Reservation Procedures.

Background:

In an effort to streamline Agriculture & Equestrian Center rentals, staff would recommend approving the attached contract, which would only be executed by the applicant.  The applicant would still be required to provide all information by the deadlines listed in the Facility Reservation Procedures.  Any animal acts not on the Board pre-approved list would still require Board action.

 

Those renting the facility would be required to pay 25% of fixed facility usage fees, in accordance with the adopted fee schedule.  The balance due would be payable on or before the Move-Out Date.  This is an equestrian industry standard.  There are risks to only obtaining 25% of the facility usage fee at the time of rental including: (i) the Licensee has the ability to pay, but simply chooses not to pay or because of a dispute between the County and the Licensee; (ii) the Licensee is unable or unwilling to pay because the Event did not generate sufficient revenue; or (iii) the Licensee or its invitees damaged the Facility and the cost of repair exceeds the amount that the Licensee is willing to pay.
