1. Authorize staff to have discussions with WCA Waste Corporation regarding potential extension scenarios under current agreement.
2. Ask that staff begin to provide financial analysis back to the Board of what those different scenarios may look like.
3. Notify commercial waste hauler of displacement hearing. Notification will follow the State Statutory process.
4. Within 60 days staff bring back analysis of the Palm Beach County Solid Waste Authority 2018 Invitation to Bid for Solid Waste and Recycling Collection Services.
5. Evaluate In-House Solid Waste and Recycling Collection Services.
August 25, 2020 - Authorize staff to notify commercial haulers of the Boards decision to displace the existing solid waste commercial haulers.

Background:
Alachua County currently has an agreement with WCA Waste Corporation for the collection of residential solid waste in the unincorporated part of Alachua County. The agreement has been in place since 2008 and it is set to expire on October 1, 2021. As amended on April 14, 2020 the agreement has a not to exceed amount of $3,826.98.31, plus additional service charges, and the compensation adjustment related to Contractor’s increase associated with the County Minimum Wage Ordinance. This value is based on the number of residential units (23,880) as determined in the 2019 non-ad Valorem Assessment Roll. Actual expenses from FY19 - FY 20 are attached. Under the terms of the agreement Alachua County has the option to extend services for an additional term not to exceed 5 years.
Commercial solid waste collection is performed by four franchised hauler in the unincorporated part of the County: WCA Waste Corporation, Waste Pro of Florida, Republic Services and Florida Express Environmental LLC. Commercial franchises are valid for one year. Current agreements are set to expire on October 1, 2020 and are renewed on an annual basis.
On August 25, 2020 the BoCC directed staff to send a letter to the four franchised commercial haulers to notify them of the County’s intent to initiate the displacement process. In order to displace commercial haulers, the County must comply with the requirements of F.S. 403.70605(3) - Displacement of Private Waste Companies. Requirements include holding a least one Public Hearing to receive input; notifying the haulers at least 45 days in advance from the hearing; initiate measures to provide displaced services within 1 year of final displacement hearing; and provide 3 years notice to displaced companies or as an alternative pay an amount equal to the companies preceding 15 months gross receipts. The displacement process will be complete in 2023.
The purpose of this presentation is to provide the BoCC an update on rest the items requested at the March 12, 2020 meeting, specifically:
1. Analysis of the Palm Beach County Solid Waste Authority 2018 Invitation to Bid for Solid Waste and Recycling Collection Services.
2. Evaluation of In-House Solid Waste and Recycling Collection Services.
3. Status of discussion with WCA Waste Corporation regarding potential extension scenarios under the existing agreement.
