Fiscal Consideration
The services will be paid from program savings. The County will pay 50% of the Gross savings for 5 years. Estimates are Gross Savings of $3 Million with a net payment to Cenergistic of $1.5 Million. One specific point to consider is a requirement of the contract for the Board to adopt a policy created in conjunction with Cenergistic and for the Manager to adopt Administrative Guidelines by March 1, 2020. There is another 60 day cure period, but in general this impacts substantial implementation of the program. If we do not substantially implement the program we will have to pay the vendor $65,700 - $110,000. A sample of an acceptable Board Policy is included with the Board packet, as well as, an acceptable School Sample of Administrative Guidelines. Management believes this concern to be a low risk issue, but it needs to be noted for the Board's consideration. The cost for terminating the contract early, including for lack of substantial implementation are on Page 9 of the contract, in Section 8.
